Terms of Use

These Terms of Use (“Terms”) govern your access to and use of TourneyPlace (the “Service”), a tool for coordinating club sports tournament weekends. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 18 years old to create a manager account. You agree to provide accurate information, keep your login credentials secure, and are responsible for all activity under your account. Notify us promptly of any unauthorized use.

The Service

TourneyPlace lets managers publish tournament schedules and information and notify families of updates by email and SMS. The Service is provided on an ongoing, evolving basis and may be a pilot or beta offering; features may change, and delivery and timing of notifications are not guaranteed.

Your content and roster information

You are responsible for the content you submit, including rosters, messages, announcements, polls, carpools, and sign-ups. When you add another person’s information (such as a parent’s or player’s name, email, or phone number) or contact them through the Service, you represent and warrant that you have the authority and any necessary consent to do so, including consent to receive email and SMS messages related to the team. If a member is a minor, you represent that you have the appropriate authority or parental/guardian consent.

You retain ownership of the content you submit. You grant us a limited, non-exclusive license to host, store, process, and display that content as necessary to operate and provide the Service.

Acceptable use

You agree not to:

  • Use the Service for any unlawful, harmful, or abusive purpose.
  • Send spam or send messages to people who have not consented to receive them.
  • Upload content that is unlawful, harassing, or infringes others’ rights.
  • Attempt to access accounts, data, or systems you are not authorized to access.
  • Interfere with or disrupt the Service, or attempt to reverse engineer, scrape, or circumvent its security.

Communications consent

By providing an email address or phone number, or by using the Service, you consent to receive messages related to your team and the Service. You can opt out of non-essential emails in your settings and opt out of SMS by replying STOP. Some messages (such as sign-in links) are necessary to use the Service.

Third-party services

The Service relies on third-party providers (for example, for hosting, SMS, email, and maps). We are not responsible for the acts, omissions, or availability of those providers, and your use may be subject to their terms.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that any notification will be delivered or delivered on time. You are responsible for independently confirming time-sensitive information.

Limitation of liability

To the fullest extent permitted by law, TourneyPlace and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the claim, or one hundred U.S. dollars ($100).

Indemnification

You agree to indemnify and hold harmless TourneyPlace and its operators from any claims, damages, or expenses arising out of your content, your use of the Service, or your violation of these Terms or of any rights of another person, including claims relating to contacting members without proper consent.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service.

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-laws principles. Any disputes will be subject to the courts located there, unless otherwise required by applicable law.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
